Terms of Service
These terms describe the general conditions for authorized IT consulting, software development, web development, infrastructure consulting, technical support, and related digital services provided by YellowStone River Digital LLC.

Acceptance of Terms
By requesting services, approving a scope of work, using deliverables, or paying an invoice, the client agrees to the applicable written scope and these Terms of Service unless a separate signed agreement states otherwise.
Services
YellowStone River Digital LLC provides professional authorized IT consulting, software development, web design and development, Windows setup and performance optimization, Linux VPS setup and hardening, self-hosted service deployment, Proxmox virtualization support, infrastructure consulting, diagnostics, troubleshooting, and related digital services.
Scope of Work
Services are performed according to an agreed written scope, quote, hourly estimate, retainer arrangement, or other documented instruction. Payment of an invoice may confirm acceptance of the scope and applicable terms. Work outside the agreed scope may require a revised estimate, change order, or separate authorization.
Client Responsibilities
- Provide accurate information about identity, authority, business, jurisdiction, systems, accounts, infrastructure, intended use, billing details, and requirements.
- Confirm that the client has authority to request work on the relevant systems, accounts, data, infrastructure, and services.
- Maintain backups unless backup services are explicitly included in the scope.
- Review deliverables, credentials, invoices, and handover documentation promptly.
- Comply with applicable laws, sanctions, export controls, provider policies, banking rules, payment processor rules, and third-party service terms.
Authorized Access Only
Work is performed only under authorized access and agreed scope. The client must not request access to systems, accounts, data, networks, infrastructure, or services that the client does not own, control, or have permission to administer.
Remote Support Boundaries
Technical support is provided only after a client-initiated request and agreed scope. The company does not provide unsolicited technical support, scare-based support, fake virus alert remediation, high-pressure repair sales, deceptive diagnostics, or deceptive remote access. Any remote access must be client-authorized, limited to the agreed scope, and used only for legitimate troubleshooting or implementation.
Infrastructure Responsibility
YellowStone River Digital LLC does not sell, lease, resell, or provide VPS, server, cloud, proxy, or hosting infrastructure as a standalone service. The company provides consulting, setup, hardening, administration, troubleshooting, documentation, and support for infrastructure that the client owns, controls, or contracts directly with a third-party provider. For new infrastructure projects, clients are generally expected to contract directly with the infrastructure provider.
Third-Party Infrastructure Accounts
The client remains responsible for the lawful use, provider terms, billing relationship, content, data, backups, credentials, users, and activity associated with any third-party infrastructure account or service the client owns, controls, or contracts. YellowStone River Digital LLC is not responsible for third-party provider suspensions, abuse reports, account limitations, billing disputes, pricing changes, provider outages, data loss, or enforcement actions unless otherwise required by applicable law or a signed written agreement.
Prohibited Use
Clients must not request illegal, abusive, deceptive, harmful, sanctioned, regulated, restricted, or unauthorized activity. Prohibited requests include spam, phishing, malware, credential theft, unauthorized hacking, evasion of security controls, data exfiltration, illegal hosting, infrastructure abuse, proxy abuse, botnets, abusive crypto mining, payment facilitation, money transmission, escrow, gambling, adult entertainment, cannabis, regulated pharmaceuticals, weapons, fake IDs, counterfeit goods, and activity that violates applicable law, sanctions, export controls, provider policies, banking rules, or payment processor rules.
Restricted Client Industries
The company may refuse or terminate work for clients, projects, websites, applications, or infrastructure connected to restricted or prohibited industries, including money services businesses, payment facilitation, escrow, investment or crypto services, adult entertainment, gambling, cannabis, regulated pharmaceuticals, weapons, fake IDs, counterfeit goods, illegal drugs, unlawful content, or any business that creates unacceptable legal, payment, banking, provider, sanctions, export control, security, or abuse risk.
Sanctions, Export Controls, and Restricted Parties
YellowStone River Digital LLC does not provide services to sanctioned persons, sanctioned entities, embargoed jurisdictions, restricted parties, or parties restricted under applicable U.S. government sanctions, export control, or restricted party lists, including lists administered by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), the U.S. Department of Commerce, or other applicable authorities.
Restricted jurisdictions may include, without limitation, Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine, as well as other jurisdictions, persons, entities, regions, sectors, or activities restricted by applicable U.S. government sanctions, export controls, provider rules, banking rules, or payment processor rules.
Restricted services may include, without limitation, certain IT, cloud-related, software, or infrastructure administration services to or involving Russia where prohibited by applicable U.S. government sanctions, export controls, provider rules, banking rules, or payment processor rules.
The company may review clients, counterparties, projects, jurisdictions, infrastructure, and intended use against applicable U.S. government sanctions, export control, and restricted party requirements, including OFAC sanctions lists and U.S. Department of Commerce restricted party lists.
The company does not provide IT consultancy, IT support, cloud-related services, infrastructure administration, software design, or related services where prohibited by U.S. sanctions, export controls, provider rules, banking rules, or payment processor rules.
Clients must not attempt to use YellowStone River Digital LLC to evade sanctions, export controls, provider restrictions, payment processor restrictions, banking restrictions, geographic restrictions, identity verification, beneficial ownership review, or lawful compliance requirements.
YellowStone River Digital LLC may refuse, suspend, or terminate work when a sanctions, export control, restricted party, provider, banking, payment processor, legal, security, or abuse concern exists.
Payments and Invoices
Invoices are issued after consultation, assessment, scope approval, milestone completion, or another agreed billing arrangement. Invoices are generally issued in USD unless otherwise agreed. When available and approved, payments may be processed through Stripe-hosted invoices. YellowStone River Digital LLC does not store full payment card numbers on its own servers and does not provide payment facilitation, escrow, money transmission, crypto services, investment services, or financial services.
Third-Party Costs
Third-party infrastructure costs, including VPS, cloud, domain, hosting, software, licensing, backup, monitoring, and email services, are normally billed directly by the third-party provider to the client unless otherwise agreed in writing. YellowStone River Digital LLC does not sell, lease, resell, or provide these third-party services as a standalone provider.
Taxes
Clients are responsible for any applicable taxes, duties, or government charges unless the invoice states otherwise. Tax handling may depend on client location, service type, and applicable law.
Refunds and Cancellations
Refunds and cancellations are handled according to the applicable scope, invoice, retainer terms, and the Refund and Cancellation Policy. Completed work, diagnostic time, consulting time, and already-performed technical services are generally non-refundable.
Intellectual Property
Unless otherwise agreed in writing, client-provided materials remain the client's property. Custom deliverables created for the client are transferred or licensed according to the written scope after payment of applicable invoices. YellowStone River Digital LLC retains ownership of pre-existing tools, templates, know-how, reusable methods, and general technical knowledge.
Third-Party Services
Services may involve third-party providers such as hosting companies, cloud platforms, domain registrars, software vendors, Cloudflare, Stripe, or open-source projects. The client is responsible for reviewing and complying with third-party terms. YellowStone River Digital LLC is not responsible for third-party outages, policy changes, pricing changes, enforcement actions, account limitations, sanctions restrictions, abuse reports, or service limitations.
Client Information and Accuracy
Clients are responsible for providing accurate information about their identity, authority, business, jurisdiction, infrastructure, intended use, billing details, and any other information reasonably needed to assess whether a project can be accepted or continued.
Security Limitations
Security work reduces risk but cannot eliminate all risk. No service, website, network, VPS, software, or system can be guaranteed secure, uninterrupted, error-free, or immune from future compromise. Clients remain responsible for ongoing access control, updates, backups, monitoring, and operational decisions unless expressly included in an active scope.
No Guarantee of Uninterrupted Systems
Technical services may require restarts, configuration changes, migrations, updates, or provider-side actions. YellowStone River Digital LLC does not guarantee uninterrupted operation of client systems, third-party services, networks, websites, or infrastructure.
Limitation of Liability
To the maximum extent permitted by applicable law, YellowStone River Digital LLC will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, revenue, data, goodwill, or business opportunity. Any aggregate liability is limited to amounts paid for the specific service giving rise to the claim, unless a different limit is required by law or agreed in writing.
Confidentiality
Non-public client information received during an engagement is treated as confidential and used only to provide services, support, billing, compliance, abuse prevention, security, and related business functions. Clients should not submit passwords, private keys, payment card numbers, recovery codes, seed phrases, access tokens, or sensitive credentials through public forms.
Termination
Either party may end an engagement according to the written scope, retainer terms, or applicable law. YellowStone River Digital LLC may refuse, suspend, or terminate work involving prohibited activity, restricted industries, sanctions concerns, export control concerns, restricted party concerns, unsafe instructions, missing authorization, non-payment, provider policy violations, payment processor concerns, banking concerns, infrastructure abuse concerns, or unreasonable technical, legal, compliance, security, or abuse risk.
